Affirmative Action Programs

The Affirmative Action Program thresholds are:

Supply & Service: 

  • Executive Order 11246: §60-2.1 b (50 employees + $50,000 or more in contracts) 

  • Section 503: §60-741.40 b (50 employees + $50,000 or more in contracts) 

  • VEVRAA: §60-300.40 a (50 employees + $100,000 or more in contracts) 

Construction: 

  • Executive Order 11246: §60-4.1 (Any number of employees + $10,000 or more in contracts) 

  • Section 503: §60-741.1 b (Any number of employees + $10,000 or more in contracts) 

  • VEVRAA: §60-300.1 b (50 employees + $100,000 or more in contracts) 

         

   Note: VEVRAA requirements have changed from $150,000 to $100,000.

Compliant Programs

We will review your organization’s employee data, do a deep statistical analysis, and compile your three Affirmative Action Programs satisfying your Executive Order 11246, Section 503, and VEVRAA requirements. These programs will be custom-tailored to your organization's makeup and needs.

Pre-Audit Assessment &
Statistical Analysis

Our team of mathematicians will perform a pre-audit on your organization. This will simulate the initial inquiry conducted by the OFCCP. We will determine your compliance levels as it pertains to gender, race, disability, and protected veteran status. They will be compared to your industry specific hiring pool and weighted against the available job groups as outlined by the US Census.

Consultation & Guidance

Upon the completion of the Affirmative Action Program, we will meet with your team to discuss the current state of your compliance and the level of risk your organization is exposed to. We will offer guidance and actions based on regulations and our statistical analysis.

  • Total Payout : $499,394.12

LinkedIn Corporation

  • Offense : Gender-Based Discrimination

  • Total Payout : $1,800,000.00

Cerner Corporation

  • Offense : Hiring Discrimination

  • Total Payout : $1,860,000.00

Financial Impacts

Federal Code : §60-1.26 (A2) 

You will owe financial compensation and pay relief for victims of discrimination.

Such individuals do not need to have filed a complaint. These individuals and the relief amount will be determined by the OFCCP.

Enforcement Proceedings

Federal Code : §60-1.27 (b) 

A contractor may be debarred from receiving future contracts or modifications or extensions of existing contracts

You can lose your current federal contract and be ineligible for future federal contracts.
